OUT OF STOCK/SUBSTITUTED PRODUCTS Sometimes products selected by customers are either out of stock or no longer available at times and we have no control of this since we depend on our vendors for products. In these cases, we will replace the garment with a similar quality product. You will be notified if a substitution is required. ACCURACY OF GARMENT OR INK COLORS While we have made every effort to display as accurately as possible the colors and/or graphics of our products that appear on the Site, we cannot guarantee that your monitor’s display of any color and/or graphic will be accurate. The colors you see will depend on your monitor and may be different from the actual colors of our product. We will have no liability (whether for damages, return of merchandise for credit, or otherwise) as a result of any variances between the appearance of colors and/or graphics displayed on your monitor and on any finished product purchased by you. All printed graphics/logos with five (5) colors or more will be printed with a digital process when printed to garments. Custom Pantone ink colors are not eligible for graphics with five (5) or more colors and will print as-is with the closest color possible. Digital processes may not be as vibrant as the graphic on your computer monitor. COPYRIGHTS, TRADEMARKS AND OTHER INTELLECTUAL PROPERTY RIGHTS Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs, and written and other materials that are part of the Site are copyrights, trademarks, trade dress and/or other intellectual properties owned, controlled, or licensed by Decal Monkey LLC. All other trademarks, service marks, product names, and company names or logos appearing on the Site are the property of their respective owners. Any use of such trademarks, service marks, product names, and company names or logos, including the reproduction, modification, distribution, or republication of same without the prior written permission of the owner of same, is strictly prohibited. Warranty/Disclaimer of Liability Our liability to you, if any, shall not exceed the total of the invoice for service and products provided on the transaction in dispute. We shall not be liable for indirect, incidental, consequential, reliance or special damages for harm to business, lost profits, lost savings or lost revenues, whether or not we have been advised of the possibility of such damages. We shall not be liable for any damage that you may suffer arising out of use, or inability to use, the services or products provided hereunder unless such damage is a caused intentional act of Decal Monkey LLC. We shall not be liable for unauthorized access by third parties to your transmission facilities, premises or equipment or for unauthorized access to or alteration, theft, loss or destruction of user’s network, systems, applications, data files, programs, procedures, or information through accident, fraudulent means or devices, or any other method. These limitations of liability shall apply regardless of the form of action, whether in contract, warranty, strict liability or tort, and shall survive failure of an exclusive remedy. This provision will survive any sale completed with you and any change or elimination of this Agreement and/or the Site. Indemnification You agree to indemnify, defend and hold harmless Decal Monkey LLC, and its directors, members, officers, employees and agents against all damages, claims, liability, costs, and expenses, including but not limited to reasonable attorneys fees, arising out of violation of any of the provisions of this Agreement by you or anyone accessing decalmonkey.biz under your account. Governing Law Decal Monkey LLC is in the State of Arizona. The laws of the State of Arizona will govern all terms, conditions and disclaimers on the Site, including this Agreement, without giving effect to any principles of conflicts of laws

Refund Policy

RETURNS/EXCHANGES: Custom T-Shirts and Other Custom Orders All Custom Orders or any other custom items sales are FINAL. No refunds/exchanges will be issued. We all work very hard to make sure that mistakes are not made, but we are all human and mistakes do happen. If the mistake is on our part we will provide a replacement or store credit. Decal Monkey is not responsible for replacing garments provided by the customer. ORDER CANCELLATIONS All Custom Orders or any other custom items sales are FINAL. However, if contacted within 24 hours (Does NOT apply to Rush Orders), we will try to assist with canceling your order. We operate very quickly at Decal Monkey so many orders are completed within 24 hours. Any order that has been completed or started cannot be cancelled. We do not process order cancellations on printed or decorated merchandise. You must cancel your order within 24 hours of placing your order (Does NOT apply to Rush Orders) All canceled orders are subject to a 15% or $25 (whichever is greater) restocking charge, in addition to both outbound and return freight costs.

Delivery Policy

All orders will ship within 24hr of completion. All orders will be shipped by (Regular Post Mail ) USPS or by (Ground, Express or Next Day) UPS in the United States ONLY. Please Note: We make every effort to guarantee ship dates on our products. However, delays on the part of UPS/FEDEX/USPS, ETC can sometimes occur (weather or aircraft issues) which are out of our control. We cannot be held responsible for such delays.
